Broadcom Co-Founders Linked to Probe

SANTA ANA, Calif. -- Federal prosecutors yesterday identified Broadcom Corp. co-founders Henry T. Nicholas III and Henry Samueli as "unindicted potential co-conspirators" in a federal probe of alleged options backdating at the semiconductor maker.
Mr. Nicholas, who is no longer with the company, and Mr. Samueli, the chairman and chief technical officer, were identified as "Executive A" and "Executive B" in a plea agreement by former human- resources executive Nancy Tullos.
U.S. District Judge Cormac J. Carney said not identifying them would undermine the factual basis of the plea deal and violate the principles of open-court hearings. Assistant U.S. Attorney Andrew Stolper argued that releasing their names would create prejudice against them since they haven't been indicted.
A Broadcom spokesman and attorneys for Messrs. Nicholas and Samueli couldn't be reached.
