West Virginia: Reconsidering An Energy Ruling; [Brief]

The State Supreme Court unanimously voted to reconsider a 3-to-2 decision that had thrown out a $50 million verdict against Massey Energy, a coal company. Chief Justice Elliott E. Maynard withdrew from the case last week after the publication of photographs of him and Massey's chief executive, Don L. Blankenship, vacationing in Monte Carlo. A lower-court judge, Donald H. Cookman, replaced Chief Justice Maynard on the case, which will be re-argued March 12.
